The Jacksonville Society is an affiliation of fine private Clubs in the Jacksonville area and around the world. As a member of the Jacksonville Society you will enjoy full social privileges, golf, tennis and pool access (where available) on a space-available basis at preferred rates. The ATP Tour Tennis Club will serve as your home club with full privileges.
TENNIS MEMBERSHIP
You, your spouse and any children under the age of 21 will enjoy full privileges, unlimited use of all of our Grand Slam court surfaces including: grass; red and green clay; and hard court. You will have use of all the locker room amenities—whirlpool and sauna, as well as the exercise room. There are also child-care services available. We have a fully-stocked pro shop for all your tennis needs.
Enjoy the same privileges as a resident member. However, you must live outside of St. Johns, Duval, Clay, Nassau and Baker counties for at least six months of the year to take advantage of this membership benefit.
TERMS & CONDITIONS OF MEMBERSHIP
1. Approval of Application—This application for membership at the ATP Tennis Club in Ponte Vedra Beach, Florida is subject to the approval of a membership committee appointed by the ATP, which may accept or reject an application in its sole discretion.
2. Rules and Regulations—The applicant further agrees to abide by all rules and regulations set forth by the ATP. All such rules and regulations shall be subject to change from time to time. Applicant agrees to abide by all such bylaws, rules, regulations and policies and to exercise due care in the protection and maintenance of ATP’s Tennis Club.
3. Fees and Dues—Applicant agrees to pay the initiation fee set forth for the membership specified herewith. Applicant further agrees to pay such other user fees and/or periodic dues as the ATP may set and change from time to time with respect to applicants class of membership. Applicant acknowledges that amount paid by it/him/her as initiation fees, user fees, or periodic dues are non-refundable and may be expended in the operation and improvements of the ATP Tennis Club and will not be held in trust or escrow.
4. Financial Responsibilities—Applicant agrees to be responsible for payment of any and all charges incurred at or with respect to the ATP Tennis Club by Applicant, Applicant’s designees and guests and any other persons using the ATP Tennis Club by virtue of Applicant’s membership. If it should become necessary for the Club to institute proceedings to collect any delinquent accounts, Applicant shall be liable for all fees and costs including any credit bureau fees, collection agency fees, attorney fees and other related costs.
Applicant may terminate membership in the Tennis Club by delivering written notice of termination 30 days in advance of the effective terminated date to the Tennis Club’s office. Applicant shall remain liable for any unpaid fees and charges or dues.
5. Other Responsibilities—Applicant agrees to be responsible for the behavior at the ATP Tennis Club of, and any damage to the ATP Tennis Club caused by, Applicant, Applicant’s designee and guests and any other person using the ATP’s Tennis Club by virtue of the Applicant’s membership. Applicant understands and agrees that ATP, in its sole discretion, may restrict the use of the Tennis Club by guests and other persons. Applicant further understands and agrees that membership in the Tennis Club may be suspended or revoked if the bylaws, rules, regulations or policies are violated by Applicant, Applicant’s designees, or guest or other persons using the facility by virtue of the Applicant’s membership.
6. Use of Facilities—Applicant acknowledges that certain grounds and facilities of the ATP Tennis Club may be available for use by only certain classes of members. The use of the grounds and facilities of the ATP by any member may be restricted or curtailed in the sole discretion of ATP and, in any event, will be subject to scheduling of tournaments, clinics and other ATP events.
7. Nature of Interests—Membership in the ATP Tennis Club does not confer any proprietary interest in the facilities or assets of ATP. Applicant will not acquire any non-terminable right to use the ATP facilities. Membership is personal to Applicant and is not transferable, salable, or refundable, and my not be pledged or used as collateral. If ATP sells, transfers or forfeits its interest in the Tennis Club to any third party, the members’ rights in the Club shall be the responsibility of such successor in interest to ATP, and the Applicant, in such circumstances, shall have no claims against ATP or any entity affiliated therewith for refunds or damages; or if ATP in its sole discretion closes the facility (either temporarily or permanently), Applicant shall have no claims against ATP or any entity associated therewith for refunds or damages.
8. Limitation of Liabilities—Applicant hereby agrees that ATP and its employees and agents shall not be liable for any losses or damages arising out of the use of the ATP Tennis Club by Applicant, Applicant’s designees, guests or other persons using the facility by virtue of Applicant’s membership, except for losses or damages arising as direct result of the gross negligence or willful misconduct of ATP, or its employees or agents.
9. Submission of Check—A check in the amount of the initial installment of the initiation fee required for Applicant’s class of membership must accompany this Application. If for any reason this Application is not approved by the Membership Committee, Applicant’s check shall be returned promptly to the Applicant and this Application shall be deemed void. Applicant waives any and all claims that may arise or accrue because of denial of membership.
10. Operation of Tennis Club—In the event ATP determines to operate the Tennis Club through a subsidiary, the obligations of ATP hereunder shall become the obligations of such subsidiary, and ATP shall be released from such obligations.
11. Entire Agreement—Applicant acknowledges that the foregoing constitutes the entire understanding between Applicant and ATP and that there are no other written or oral understandings, promises or agreements between them or on which Applicant has relied in making this Application.
Applicant has read and understood and agrees to all terms and conditions of membership of the ATP Tennis Club and affirms that all of the information provided on this agreement is true and correct.
